Mediation of family disputes is conducted based on the principle of privacy, ensuring a trusted and secure environment for the process.
The principle of privacy protects the information, documents, and content of negotiations provided by the parties, guaranteeing that they will not be disclosed to third parties or used for other purposes, except in cases prescribed by law. Privacy encourages open and honest communication, as parties can discuss dispute details witho
ut fear that the information might be used against them. If mediation does not result in a settlement and the case proceeds to court, statements made during mediation cannot be used by any party in the litigation, providing genuine freedom for the parties to be open during mediation and seek compromise solutions.

In the Republic of Armenia, this principle is guaranteed by the Law on Mediation.
Unlike mediation, judicial proceedings are generally open and public, as their purpose is to ensure the transparency of justice. According to Armenian law, court hearings are primarily conducted openly, except in specific cases where the court may decide to hold closed proceedings. Data presented during litigation, including documents and testimonies, become part of the case and may be accessible to third parties or used in other proceedings. The level of privacy is lower, as court decisions are published on publicly accessible platforms to ensure public trust and the rule of law.

Even if a court decides to hold closed proceedings, cases involving children still involve the Guardianship and Trusteeship Body, which provides conclusions on the case. This body operates through a commission, where at least a dozen employees become privy to sensitive details of the family matter.
In contrast, during mediation, third parties unrelated to the dispute are not involved in the process by the licensed mediator, highlighting the key advantage of mediation in family disputes.
